Terms of service for ordering from Sukkah Mart.

1. Acceptance of Terms
By placing an order, using our live chat, or otherwise using sukkahmart.net (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.
2. Who We Are / Service Area
Sukkah Mart is operated by Mitzvah Mart LLC ("we," "us"). We sell bamboo schach mats, sukkah kits, murals, add-on services, and (Chicago-only) rentals, delivered exclusively to zip codes within Greater Chicago, IL and Greater Lakewood, NJ. If your delivery address falls outside these zones, the Site will offer an in-store pickup option instead of delivery. We do not ship nationally.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to place an order. By ordering, you confirm the delivery/pickup and payment information you provide is accurate.
4. Products, Pricing & Availability
- All prices are set in our live product catalog and are subject to change without notice, including between the time you add an item to cart and the time you check out.
- Before your order is finalized, we re-verify current pricing. If a price has changed since you added an item to your cart, you will be shown the updated price and asked to confirm before payment is taken.
- We reserve the right to limit quantities, correct pricing or listing errors, and refuse or cancel any order, including after acceptance, if a product is mispriced, mislabeled, or unavailable.
- Applicable sales tax is calculated based on your delivery market (Illinois or New Jersey) and product/service type, and is shown as a separate line item at checkout. Assembly labor is billed and taxed separately from goods where required by IL and NJ law.
5. Orders & Payment
We offer two payment methods:
Card / Wallet: Payment is charged at checkout via our payment processor. Your order is confirmed immediately upon successful payment.
Zelle: Choosing Zelle applies a 3% discount to your order total. After checkout, you will receive instructions to send payment via Zelle, including an order number to include in the payment memo. Your order status will show as "payment sent" once you confirm you have sent it, and will not move to "confirmed" - and delivery/pickup will not be scheduled - until we manually verify receipt of your Zelle payment, within 2 business days of receipt. If we cannot match or verify your Zelle payment within 2 business days, we may follow up for confirmation, cancel the order, or ask you to re-place it or use another payment method. Zelle payments sent without a matching order or order number may be delayed in processing.
We reserve the right to cancel any unpaid or unverifiable order.
6. Delivery, Pickup & Time-Sensitive Orders
Sukkot has a fixed date each year, and our products are needed before the holiday begins. It is your responsibility to order early enough to allow for delivery, pickup, and assembly before Sukkot. We are not liable for orders placed too close to the holiday to be fulfilled in time, and we may publish and enforce order-by cutoff dates as the holiday approaches. Delivery windows are estimates, not guarantees, and may be affected by weather, carrier delays, or other events outside our control (see Section 12, Force Majeure).
Orders outside our IL/NJ delivery zip codes are pickup-only; you are responsible for arranging transport from the pickup location.
7. Assembly Services
Assembly is an optional add-on performed at your property. By purchasing assembly:
- You confirm you have authority to grant access to the installation location.
- You assume responsibility for clearing the installation area of obstructions and hazards.
- Assembly may be performed by us directly, by a subcontractor, or by a third-party vendor engaged on our behalf. To the maximum extent permitted by Illinois and New Jersey law, our liability for property damage or personal injury arising from assembly is limited to the cost of the assembly service.
8. Rentals (Chicago Only)
Rental items remain our property. You are responsible for the rented item(s) from delivery until return/pickup, including any loss, theft, or damage beyond normal wear. We may charge your original payment method for damage or non-return, where technically supported, or invoice you separately for Zelle-paid rentals.
9. Cancellations, Returns & Refunds
- Given the holiday-specific and time-sensitive nature of our products, cancellation and return requests must be made before your scheduled delivery/pickup to be eligible for a refund.
- Custom or made-to-order items (e.g., custom-sized schach, murals) are non-refundable once production begins.
- Refunds for card payments are issued to the original payment method. Refunds for Zelle payments are issued via Zelle or another mutually agreed method, and may take longer to process than card refunds.
- Assembly service fees are non-refundable once assembly has been performed.
10. Live Chat
Our Site uses a third-party live chat widget for customer support. Chat is not monitored 24/7 and is not intended for order changes requiring immediate action or for sending payment/banking information. Chat transcripts may be reviewed by our team and are subject to the chat provider's own terms and privacy practices - see our Privacy Policy.
11. User Conduct
You agree not to: provide false order or payment information; attempt to circumvent our zip-code delivery gating; use the Site for any unlawful purpose; or interfere with the Site's operation or security.
12. Force Majeure
We are not liable for delay or failure to perform due to causes beyond our reasonable control, including weather, natural disaster, carrier/supplier disruption, labor shortage, or other events that prevent timely delivery or assembly before Sukkot.
13. Disclaimers
The Site and products are provided "as is." Except as expressly stated, we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the extent permitted by Illinois and New Jersey law. We do not guarantee that structures built using our products will meet any particular halachic or religious standard; customers are responsible for confirming their sukkah meets their own requirements.
14. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from your order or use of the Site is limited to the amount you paid for the product or service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
15. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Site, violation of these Terms, or the information you provide being false or misleading.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Cook County, Illinois, and you consent to jurisdiction there.
17. Changes to These Terms
We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will update the "Last Updated" date above.
